The intention was there, the means were there. That is enough to prove attempted murder.

No its not.

If the court wants to rule that death threats of this sort are against the law, whether or not they were real, then fair enough. I would expect then to see people like Kathy Griffin also put in jail, as well as all the people who say things like "damn, we need to find a better shooter" after the assassination attempt.
