As you kids know, the age of consent in Brazil is 14. Supposedly, any sexual relationship under the age of 14 is illegal. The second highest court in Brazil, the Superior Tribunal de Justiça, has, however, recently absolved people in relationships with kids under that age under specific conditions. Namely: parent consent, love between the parties and (which will be the goofiest one, just keep reading) closeness in age. Now, in this news report from April this year, which I missed (I'm sorry for that), the relationship between a 22-year-old man and a 13-year-old girl was declared OK, because of those three conditions. According to the judges, the victim's sexual dignity was not damaged and one must not close their eyes to the individual merit of the relationship and simply blindly apply the law as it is written, lest the result ends up being unfair and damaging to the child. Now... how come that relationship fits into the third criterion? How is 22 close to 13 in this case? Well, the Child and Adolescent Statute, in Brazil, defines "adolescent" as someone between the ages of 12 and 17. And the World Health Organization defines "youth" as a period lasting between the ages of 15 to 24. So, they are in adjacent categories: adolescent and youth. In the edge case of the kid being 12, it would still be acceptable. I guess the WHO fucked up nice for us. It is not full liberation, but it is a step in the right direction and shows that the law does not have to change, if the interpretation changes instead. The link I share is in Portuguese.
