you are right, that is the legal meaning, and I guess its what most people think of as well.

its kind of vague though, "in part" could mean anything.

The real problem with the idea of a 'gay genocide' is not the fact that they weren't all killed, but rather that homosexuals are not "a national, ethnical, racial or religious group"

true, although identity politics seems to try co-opt the meaning, and expand the definition to sexual identity.
