Legalisation vs decriminalisation

What kind of take is it that decriminalisation is better than legalisation because legalisation implies regulations, and decriminalisation implies that the law doesn't care about the subject?

Something can be legal without being regulated, and if something is decriminalised without being legalised, it's still illegal, just not criminalised. Offenders could face civil penalties for it.

Take the case of Portugal's drug laws. Portugal is often said to have decriminalised drugs. Well, they're still illegal, but some drug offences have been made civil offences rather than criminal ones. And there are still criminal offences. Drugs are highly regulated and prohibited in Portugal. Surely that's not what you want for fictional sexual outlets?
