You can sell baking soda to someone telling them it's heroin. Yet if you get arrested doing so you'll be charged with and likely convicted of distributing/trafficking in narcotics.....and it'll hold up all the way through the court system. Because it isn't always the technical act that's the important thing. You need two other things to commit a crime....Intent and mens rea, or guilty mind.... The fact some dimbulb on Grindr wasn't actually talking to a minor is irrelevant. He obviously intended to commit a criminal act by responding to an advertised minor, and showed a guilty mind by knowing full well sex acts with minors is illegal, but making arrangements to do so anyhow. The fact that said "minor" was really a cop just shows that you should never try to draw to n inside straight.
