It completely depends on the text of the statute. There are 51 different definitions of child porn in this country, not including the territories. We're talking about one of them, the federal definition.

State laws certainly vary. Your friend I'm sure was charged under a state law. If the definition in that state included language like "for the purpose of sexual arousal," then they have to prove the viewer was sexually stimulated, and his "pedophilia" and prior criminal history would be relevant.

With Azov we're so far talking about federal, though, where it's not relevant.
