I think they know they could not convict him

They never would have offered that deal if they really thought that they could win at trial. Remember the local cop went out of his way to order a copy of the book so a guy living in Colorado could be dragged into a Florida court in the first place. I think they decided that just getting something on a criminal record was as good as they could do, so they offered him a deal they were sure he would have to take.

Not everyone can be a Robin Sharpe. From what I have seen on YouTube, this guy was not up to that challenge.
